Abstract

This research discusses criminal sanctions for violations of wage provisions as regulated in Law Number 11 of 2020 concerning Job Creation and its derivative regulations. The main focus of this study is to examine the effectiveness of criminal sanctions in ensuring workers' rights related to wages and to analyze the changes in labor law norms following the enactment of the Job Creation Law.

This study uses a normative juridical approach, with data collected through literature review and analysis of statutory regulations.

The results indicate significant changes in the law enforcement mechanism regarding wage violations, particularly a shift from a repressive to an administrative approach. This shift raises debates about legal certainty and the protection of workers. Therefore, harmonization between criminal and administrative legal approaches is necessary to achieve a fair and equitable labor system for all parties.
