VICARIOUS LIABILITYAGAINST STUDENTS FROM DISCIPLINARY ACTS BY EDUCATIONAL INSTITUTIONS

This research aims to theoretically explore the forms of guarantees and rights of protection for students from violence and discrimination, and to legally analyze the limits of educational unit responsibility in implementing discipline. This research uses the Theory of Authority by Heinrich Triepe, the Theory of Unlawful Acts by R. Wirjono Projodikoro, and the Theory of Legal Protection by Philipus M. Hadjon. The research method used is normative and doctrinal prescriptive juridical, utilizing the Statute approach, the Conceptual approach to the doctrine of vicarious liability, and the Case approach. The findings of this thesis research demonstrate that educational institutions must be a safe haven for students from all forms of violence and discrimination. In enforcing discipline, schools must act within the law, uphold the principles of child protection, and make the educational process a form of development, not punishment. Any violation by educational institutions may be subject to administrative, ethical, and even criminal sanctions in accordance with applicable law. Peacemaking is an effort to restore victims of violence by providing compensation.
